This notice announces the

the Consumer Product Safety Act# N. P X2 G& T* i9 q
(‘‘CPSA’’) as amended by section 102(a)5 e. E E* W; g, u! M4 f
of the Consumer Product Safety' S$ f6 l* X/ a% |( j0 J E
Improvement Act of 2008 (‘‘CPSIA’’),
! [1 T y4 ^+ v8 R" a8 E8 s: R6 iPublic Law 110–314. Specifically, the
; k4 s3 \" ~" {* x+ o+ SCommission is staying certain of the5 z" L- N- S" n% h# ]
requirements of paragraphs 14(a)(1), (2),) s' R1 x9 ]$ k9 u* F. x
and (3) that otherwise require testing
' L4 n5 U# P2 }0 n- v1 fand issuance of certificates of! g) A5 j5 P, A5 n( U, x3 U
compliance by manufacturers, including# d* A* e" t9 k7 F. f- x
importers, of products subject to an: L, a+ t7 x v1 L* Z8 O
applicable consumer product safety rule
" c8 T( l D, G4 y _8 pas defined in the CPSA or similar rule,
0 p. q/ L% h/ A/ ]) }8 dban, standard, or regulation under any
: j1 t) v7 ?6 [3 xother Act enforced by the Commission.
y) s+ g6 o6 p5 wThis stay covers all such requirements
/ B" j: w! @7 c4 fwith the exception of:
6 U& z7 L& L* s6 z(1) Those where testing and
+ K$ k1 U# g! K5 mcertification was required by subsection
; h" c9 z Q2 K4 h14(a) of the CPSA prior to enactment of+ J b# i9 Z- h) R* y; Y
the CPSIA; and9 [; e6 k; `& M3 w5 z6 r7 F; s
(2) Those requirements, when they4 `0 p8 q1 M; {$ F# [
become effective, applicable to, S& H- |' X. b L8 M- a9 T/ p
children’s product certifications* `3 g8 u; k1 c2 k( {& ?
required to be supported by third party6 v. o2 ?" H" `3 x1 @
testing for which the Commission has
! T( M7 h: W9 D( Aissued requirements for acceptance of& z4 w7 s0 @" D! `" ^6 G- r
accreditation of third party testing+ X' O, l' K* D
laboratories to test for:4 P X3 y) _+ C* E- I5 h
• Lead paint (effective for products
& |! O; ` d3 A6 v6 E6 K' M8 Zmanufactured after December 21, 2008),
8 V: Q- g' f- c1 [9 [( V! V• Full-size and non-full size cribs and5 P9 V4 v; h0 D6 ^" z8 ~2 B
pacifiers (effective for products9 g: N; z1 o; D* b# e
manufactured after January 20, 2009),: Q) b# q. Z( F# S4 U9 y5 x
• Small parts (effective for products
0 ?. x$ [ N5 J3 Hmanufactured after February 15, 2009),
' N# L6 T' J7 Z7 N$ x! nand: B( I) t: b, y3 J
• Metal components of children’s
6 {1 u: v! `+ L, Tmetal jewelry (effective for products
5 T+ }# k( i, @. _6 j( C! Pmanufactured after March 23, 2009);

7 U( D5 g/ P! w; [" ]8 i(3) Any and all certifications" ], z. Y- i6 y# W3 D
expressly required by CPSC regulations;; E5 d0 r: E, g) j5 J. F% _

(4) The certifications required due to) H9 v4 [$ A& t. @9 o" O+ i$ V! {
certain requirements of the Virginia
0 ^) r5 N; Y; r7 c8 BGraeme Baker Pool & Spa Safety Act* f. {$ b% J7 q4 t! H
being defined as consumer product$ m# t- [9 U) f) T
safety ‘‘rules;’’ and) c% C. H( e; n2 J2 p
(5) The certifications of compliance \$ L" L" {9 H5 K; O
required for ATVs in section 42(a)(2) of
* W2 t0 z; [! G. n& A$ B5 C1 mthe CPSA which were added by CPSIA;$ U3 c2 G* N! ], G9 Y" _7 T
and
9 P" y6 p. s8 J; f1 [(6) Any voluntary guarantees" |2 w$ r0 `: }/ [7 o
provided for in the Flammable Fabrics
2 D' M+ s" _" k% oAct (‘‘FFA’’) or otherwise (to the extent* G. f1 I* ~0 T, m
a guarantor wishes to issue one).
& M7 r3 r7 @6 Y% s% Y8 P ~This stay will remain in effect until7 P1 X" \8 x- G; L3 A, f
February 10, 2010, at which time the& G7 E$ G2 |$ j) Z3 H- I
Commission will vote to terminate the1 N- S6 P% J0 k/ C! `
stay. This stay does not alter or
, X% X+ u2 v! X, ~: vpostpone the requirement that all
) s' u! M4 F. \( \products meet applicable consumer: c, |4 \7 o5 L8 x
product safety rules as defined in the
: ^9 n1 g4 t E7 o9 ?; pCPSA or similar rules, bans, standards,% ]4 L/ v2 s" b3 }4 u G7 V. f
or regulations under any other Act
